Child Support Wage Withholding Errors: What to Check and How to Request Review

PRACTICAL CHECKLIST • UPDATED OCTOBER 2026 • GENERAL U.S. INFORMATION

Income withholding is a common, legally authorized method of collecting support. If a notice appears incorrect, focus on the exact alleged error and the specific administrative or court review process available to you.

01 Get the actual withholding notice and order

Request a copy of the current income-withholding notice, the underlying support order, and the official payment history. Confirm the case number, payee, employee, issuing jurisdiction and the effective dates of the order.

02 Compare paycheck deductions to the notice

Use payroll statements to check the pay period, gross and disposable earnings definitions, amount withheld, employer processing fees, and whether multiple orders are being enforced. The applicable withholding limits and allocation rules can vary by situation.

03 Identify mistake-of-fact questions

Under 42 U.S.C. § 666(b)(4), affected parents must be given notice of procedures to contest withholding due to a mistake of fact. Examples may include a wrong person, an incorrect amount, or an accounting error; the applicable state procedure determines what can be contested and when.

04 Ask how to submit your evidence

Follow the instructions in the notice or those provided by the issuing state agency or court. Attach relevant copies, a short item-by-item explanation, and a documented request for review or correction. Preserve proof that the material was received.

05 Do not instruct your employer to disregard an order

An employer may have legal duties to comply with a regular income-withholding notice. A private cease-and-desist letter generally does not override that duty. Use the court or agency review process and check whether a stay or corrected notice has actually been issued.

06 Track the outcome

Record each response and the date a correction would take effect. If money was improperly withheld, ask the agency what refund, adjustment or credit procedure applies. Do not assume a request suspends collection.

Bring these five items together

  • Current income-withholding notice and support order
  • Recent pay stubs and employer withholding totals
  • Payment ledger and arrears calculation
  • Specific mistake-of-fact explanation with documents
  • Proof of submission and response deadline
Legal note: 42 U.S.C. § 666(b) and 45 C.F.R. § 303.100 provide federal rules for child-support income withholding, including notice and procedures for certain factual contests. These authorities do not make withholding categorically unlawful. Read the source: 42 U.S.C. § 666(b).
